TERMS OF SERVICE

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and StorySpun LLC, an Ohio limited liability company ("StorySpun," "we," "us," or "our"), governing your access to and use of the StorySpun website, platform, and services (collectively, the "Services").

BY CREATING AN ACCOUNT OR MAKING A PURCHASE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICES.

You must be at least 18 years of age to use the Services. By agreeing to these Terms, you represent and warrant that you are 18 years of age or older.

2. Description of Services

StorySpun provides an AI-powered personalized fiction platform that generates original stories based on information you submit through an intake form ("Taste Profile"). Services include:

Generation of original short stories, novellas, and novels ("Stories") based on your Taste Profile
Professional cover art generated for each commissioned Story
Optional audiobook production with AI-synthesized multi-voice narration
A marketplace ("StorySpun Library") through which users may list and sell Stories to other users
A customer portal for accessing completed orders and managing your account

Stories are generated using artificial intelligence systems operated by third-party providers, including Anthropic, OpenAI, and others. The quality, style, and content of generated Stories may vary.

3. Accounts and Registration

To access the Services, you must create an account. You agree to:

Provide accurate, current, and complete information during registration
Maintain the security of your account credentials
Notify us immediately of any unauthorized access to your account
Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we determine, in our sole discretion, pose a risk to the platform or other users.

4. Credits, Pricing, and Payment

4.1 Credit System

The Services operate on a credit-based system. Credits are required to commission Stories and audiobooks. Credits may be purchased individually or in packs, or received through active subscription plans.

4.2 Pricing

Current pricing for credit packs and subscription plans is displayed on the StorySpun website at the time of purchase. We reserve the right to modify pricing at any time with reasonable notice to active subscribers.

4.3 Subscriptions and Automatic Renewal

IMPORTANT NOTICE REGARDING AUTOMATIC RENEWAL: StorySpun offers subscription plans that renew automatically on a monthly basis. By purchasing a subscription, you authorize StorySpun to charge your payment method on a recurring basis at the then-current subscription rate until you cancel.

The following disclosures are required by law, including California Business and Professions Code § 17600 et seq.:

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date
The charge will be made to your payment method on file at the then-current subscription rate
You may cancel your subscription at any time through your account settings or by contacting us at customersupport@storyspun.ai
Cancellation takes effect at the end of the current billing period; you retain access to your credits through that date
No partial refunds are issued for unused portions of a subscription period upon cancellation

A confirmation of your subscription, including the recurring charge amount, renewal date, and cancellation instructions, will be sent to the email address associated with your account at the time of purchase.

4.4 Refund Policy

Due to the nature of AI-generated digital content, the following refund policy applies:

Credits purchased but not yet redeemed are eligible for a full refund if requested within 7 days of the original purchase date, provided that no credit from that purchase transaction has been applied to any order
Once any credit from a given purchase transaction has been redeemed toward a Story or audiobook order, the entire transaction becomes non-refundable, regardless of how many credits from that transaction remain unused
Once a Story generation pipeline has been initiated, the credits applied to that order are non-refundable, as significant computational resources are expended at the time of initiation
If a Story fails to deliver due to a technical error on our part and cannot be successfully regenerated, we will issue a full credit refund for that order
Audiobook add-on credits are non-refundable once audiobook generation has commenced

Nothing in this refund policy limits any rights you may have under applicable consumer protection law in your jurisdiction.

4.5 Payment Processing

All payments are processed by Stripe, Inc. By making a purchase, you also agree to Stripe's terms of service. StorySpun does not store your full payment card details.

5. Content and Intellectual Property

5.1 Your Taste Profile and Inputs

You retain ownership of the personal information and preferences you submit in your Taste Profile. By submitting your Taste Profile, you grant StorySpun a limited, non-exclusive license to use that information solely for the purpose of generating your Story and operating the Services.

5.2 AI-Generated Stories — Important Copyright Notice

Stories generated by StorySpun are produced by artificial intelligence systems without direct human authorship. Under current United States copyright law, including guidance issued by the U.S. Copyright Office, purely AI-generated content may not be eligible for copyright protection.

StorySpun does not claim ownership of your generated Story. Upon delivery, StorySpun assigns to you all rights, title, and interest that StorySpun may hold in your Story, to the fullest extent permitted by applicable law.

YOU ACKNOWLEDGE AND UNDERSTAND THAT:

Copyright protection for AI-generated works is legally uncertain under current U.S. and international law
StorySpun makes no warranty or representation that your Story is protectable by copyright or any other intellectual property right
Your ability to prevent others from copying or reproducing your Story may be limited or nonexistent under current law
This legal landscape is subject to change, and StorySpun is not responsible for changes in law that affect your rights in generated content

To the extent any portion of your Story incorporates creative expression attributable to your own authorship (for example, specific plot elements, characters, or language you provided in your Taste Profile), you may hold copyright in those elements independently.

5.3 StorySpun Platform Content

All platform content, trademarks, software, design elements, and proprietary systems are owned by StorySpun LLC and protected by applicable intellectual property law. You may not copy, reproduce, or reverse-engineer any aspect of the platform.

5.4 Prohibited Content Inputs

You may not submit inputs through your Taste Profile that:

Request the inclusion of real, identifiable individuals as characters in your Story without their express consent
Request content that is defamatory, obscene, or that violates the rights of any third party
Request content that sexualizes minors or depicts child sexual abuse material in any form
Are intended to harass, intimidate, or harm any identifiable person
Request content that violates any applicable law

StorySpun reserves the right, but has no obligation, to review inputs and decline to generate content that violates these prohibitions. You are solely responsible for the inputs you submit. You agree to indemnify and hold StorySpun harmless from any claims arising from content generated based on your inputs.

6. StorySpun Library and Marketplace

6.1 Listing Your Story

You may elect to list your completed Story in the StorySpun Library. Listing is voluntary and requires your affirmative consent. By listing your Story, you:

Grant StorySpun a non-exclusive, royalty-free license to display, distribute, and sell your Story to other users through the Library
Represent and warrant that you have the right to list the Story and that the Story does not infringe any third-party rights
Acknowledge that your Story may be downloaded by other users for a fee

6.2 Creator Payouts

When another user purchases your listed Story, StorySpun will remit to you a revenue share as displayed in the platform at the time of listing, subject to:

Completion of Stripe Connect onboarding and identity verification
Satisfaction of minimum payout thresholds
Applicable Stripe processing fees
Compliance with these Terms

Payouts are processed on a monthly basis. StorySpun reserves the right to withhold payouts pending investigation of suspected fraud, Terms violations, or chargebacks. You are solely responsible for any taxes applicable to amounts you receive through the marketplace.

6.3 Removal of Listings

StorySpun may remove any listing at any time if it determines, in its sole discretion, that the listing violates these Terms, applicable law, or community standards. You may remove your listing at any time through your account settings.

7. Audiobook Services

Audiobook production uses AI-synthesized voices provided by OpenAI. By commissioning an audiobook, you acknowledge that:

The narration is produced by artificial intelligence and not by human voice actors
Distribution via third-party platforms (including Spotify and Apple Podcasts) is subject to those platforms' terms of service, including any requirements regarding disclosure of AI-generated content
You are responsible for complying with any applicable disclosure requirements on platforms where you distribute your audiobook
StorySpun does not guarantee that your audiobook will be accepted by any third-party distribution platform

8. Disclaimers and Limitation of Liability

8.1 No Warranty

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. STORYSPUN DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY PARTICULAR STORY WILL MEET YOUR EXPECTATIONS.

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STORYSPUN LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

STORYSPUN'S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO STORYSPUN IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. To the extent such limitations are not permitted in your jurisdiction, they apply only to the fullest extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless StorySpun LLC and its members, managers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Services; (b) your violation of these Terms; (c) content you submit through your Taste Profile; (d) your listing of a Story in the Library; or (e) your violation of any applicable law or third-party right.

10. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law principles.

Any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Ohio, and you consent to personal jurisdiction in those courts.

WAIVER OF CLASS ACTION: TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU WAIVE ANY RIGHT TO BRING OR PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE ACTION AGAINST STORYSPUN.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by email to the address associated with your account and by posting the updated Terms on our website. Your continued use of the Services after the effective date of the updated Terms constitutes your acceptance of the changes.

For active subscribers, material changes to subscription pricing or terms will be provided with at least 30 days' advance notice.

12. Termination

We may suspend or terminate your access to the Services at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Services ceases immediately. Credits unused at the time of termination for cause are forfeited. Credits unused at the time of termination without cause will be refunded on a pro-rata basis.

You may terminate your account at any time by contacting us at customersupport@storyspun.ai.

13. Miscellaneous

Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and StorySpun regarding the Services and supersede all prior agreements.

Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

No Waiver. Our failure to enforce any provision of these Terms shall not be construed as a waiver of our right to enforce it in the future.

Assignment. You may not assign your rights under these Terms without our prior written consent. We may assign our rights freely.
